Canada offers refugee protection to some people in Canada who fear persecution or who would be in danger if they had to leave. Some dangers they may face include
- torture
- risk to their life
- risk of cruel and unusual treatment or punishment.
Not everyone is eligible to apply for refugee status. A person is not eligible if:
- the applicant has already applied for refugee status in Canada;
- the applicant has been recognized as a refugee in another country and may be returned to that country;
- the applicant entered Canada through a designated “safe third country”;
- the applicant has been found inadmissible on grounds of security, serious criminality, organized criminality, or violation of human or international rights.
Canadian immigration officials first determine whether a refugee’s asylum claim will be granted, and if your application is submitted across the border, you can expect a quick decision on your eligibility. If you later apply for asylum with Canadian immigration, it will take longer to determine your eligibility for refugee status.
If an immigration officer determines that the applicant should be allowed into the country, the file is transferred to an independent administrative tribunal called the Immigration and Refugee Board (IRB).
The IRB determines whether the applicant is a genuine refugee and deserving of Canadian protection. The applicant must first enter the personal information form (PIF) and send it to IRB. About 12 months later, the applicant visited the hearing before the members of the IRB. In rare cases, when the evidence is crystal clear, a complainant may be granted a conviction without a hearing.
